Announcement of Settlement and Withdrawal of VARTA’s Lawsuit against EVE for Patent
2021年10月起，就惠州亿纬锂能股份有限公司（以下简称“亿纬锂能”）销售的部分纽扣电池产品涉嫌侵犯VARTA Microbattery GmbH（以下简称“瓦尔塔”）专利权事件，瓦尔塔在美国德克萨斯州的东区联邦法院提起专利侵权诉讼。亿纬锂能相应在美国专利局商标局专利审判和上诉委员会就涉案专利提起了无效申请，其中5件专利的无效申请于今年年初相继立案。
Starting from October 2021, a patent dispute arose concerning certain button cell battery products sold by Huizhou EVE Battery Co., Ltd. that were allegedly infringing on the patent rights of VARTA Microbattery GmbH. VARTA initiated a patent infringement lawsuit in the Eastern District of Texas Federal Court in the United States. In response, EVE Battery Co. filed invalidity applications with the United States Patent and Trademark Office's Patent Trial and Appeal Board for the patents in question, with invalidity proceedings initiated for five of these patents earlier this year.
近日，瓦尔塔与亿纬锂能就全球诉讼达成和解。协议约定双方在全球撤回针对彼此的所有法律程序。双方还同意拓展共同的商业机会，建立面向未来的合作互利关系。双方开始在相应法院、专利审判和上诉委员会提出撤诉、撤案申请。
In recent days, VARTA and EVE have reached a global settlement in their legal disputes. The agreement stipulates that both parties will withdraw all legal proceedings against each other worldwide. Additionally, they have agreed to explore joint business opportunities and establish a mutually beneficial partnership for the future. Both parties have initiated requests for dismissal and withdrawal of their cases and proceedings in the relevant courts and patent trial and appeal boards.
瓦尔塔与亿纬锂能已共同向美国德克萨斯州的东区联邦法院提出了撤案申请，美国德州东区法院批准了双方提交的撤案动议，瓦尔塔在美国德州东区法院发起针对亿纬锂能的专利诉正式撤销，瓦尔塔与亿纬锂能共同向美国专利商标局专利审判和上诉委员会审议提出撤销上述5件专利的无效申请。美国专利商标局专利审判和上诉委员会已经审议并批准瓦尔塔与亿纬锂能共同提出的撤销5件立案的无效申请。
VARTA and EVE have jointly submitted a motion to dismiss their case to the Eastern District Federal Court of Texas in the United States. The Eastern District Court of Texas has approved the motion to dismiss filed by both parties, effectively ending VARTA's patent lawsuit against EVE in the Eastern District Court of Texas. Additionally, VARTA and EVE have jointly requested the United States Patent and Trademark Office's Patent Trial and Appeal Board to review and dismiss the five invalidity applications related to the mentioned patents. The United States Patent and Trademark Office's Patent Trial and Appeal Board has reviewed and approved the joint request for dismissal of the five invalidity applications submitted by VARTA and EVE.

As of the date of this announcement, all global patent litigation proceedings between the VARTA and EVE have been concluded.
